These Terms of Service ("Terms") govern your access to and use of the WanderQuest mobile application and website at wanderquest.dev(the "Service") operated by WanderQuest. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
Your account
You may need to sign in (for example, with Apple) to use certain features. You are responsible for maintaining the security of your account and for all activity under it. Notify us promptly at info+wander@studio3dx.com if you suspect unauthorized access.
Description of the Service
WanderQuest helps you plan and track trips, discover places, check in at locations, and earn rewards. Trip content, place lists, distances, and map data are provided for informational and entertainment purposes. We do not guarantee the accuracy, completeness, or safety of any place, route, or recommendation.
Location services and safety
The Service uses location data to provide maps, proximity alerts, check-ins, and related features. You are solely responsible for your safety and compliance with local laws while traveling or exploring. Always pay attention to your surroundings. Do not use the Service in ways that distract you while driving or in hazardous situations.
Background location is optional and can be disabled in the app or device settings at any time.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to accounts, data, or systems
- Scrape, reverse engineer, or copy the Service except as permitted by law
- Upload malicious code or content that infringes others' rights
- Manipulate check-ins, points, badges, or other gamification systems
- Harass, abuse, or harm other users
User content
You may add trip details, places, and other content to the Service. You retain ownership of your content. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process it solely to operate and improve the Service.
You represent that you have the rights to any content you submit and that it does not violate these Terms or applicable law.
Shared trips
If you create or join shared trips, other participants may see trip details and activity you contribute. You are responsible for what you share and with whom.
Intellectual property
The Service, including its design, software, branding, curated content, and documentation, is owned by WanderQuest or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without permission.
Third-party services
The Service may integrate with or link to third-party services (such as Apple Sign In, Apple Maps, or directions apps). Your use of those services is subject to their terms and policies. We are not responsible for third-party services.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LOCATION DATA, MAPS, OR PLACE INFORMATION WILL BE ACCURATE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WANDERQUEST AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (USD $50).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless WanderQuest from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.
Changes to the Service and Terms
We may modify the Service or these Terms at any time. We will post updated Terms on this page and update the "Last updated" date. Material changes may also be communicated in the app. Continued use after changes constitutes acceptance.
Governing law and disputes
These Terms are governed by applicable law without regard to conflict of law principles. Any dispute arising from these Terms or the Service will be resolved in the courts of competent jurisdiction, except where mandatory consumer protection laws in your country require otherwise.
